The Process of Probate 

The first step is arranging the death certificate. A form will be given to you by the funeral director and your local registrar of births, deaths and marriages will issue the death certificate, certifying the details of the deceased. Several copies may be required as creditors may want to see an official copy of the official certificate.

When a will is in place

  • A will states who will be responsible for the collection of all the property and assets of the deceased and the distribution of the property. This individual is known as the executor.

When there is no will in place

  • The next of kin or an appropriate person will be elected as an ‘administrator’.
  • The administrator will need to collect information from the Creditors and in the even the deceased owns freehold or leasehold property, a valuation will need to be retrieved from a valuer or estate agent.

In the event that the deceased owns property with another person or if conveyancing services are required, our conveyancing team will be able to advise on the best course of action.

Our team will also be able to assist the administrator or executor if the deceased estate is deemed insolvent, which means there is not enough money to cover the debts of the deceased.
